Foundation Charter

The Highest Internal Governing Document of the Foundation

This Foundation Charter serves as the highest internal governing document of Angelus – Cahaya Anak. It defines the mission, ethical principles, child protection standards, governance framework, and financial integrity of the Foundation.

The Charter establishes a clear moral and operational foundation based on the absolute priority of child protection, human dignity, transparency, accountability, and long-term sustainability. It provides binding principles that guide all activities, decisions, projects, and relationships of the Foundation.

This Charter takes precedence over all internal policies, protocols, and operational documents. All associated persons, including management, staff, volunteers, partners, and cooperating entities, are required to act in full compliance with this Charter.

Angelus – Cahaya Anak is committed to building a safe, ethical, and self-sustaining system of care, education, and development for children and vulnerable communities, in accordance with international child protection standards and applicable law.

§1 – Fundamental Mission

(1) Angelus – Cahaya Anak is a humanitarian organization established to protect and support children and vulnerable communities through long-term, sustainable projects.

(2) The Foundation's mission is to create a self-sufficient and ethically grounded system of care, education, and development, and to provide a safe future for children.

(3) The Foundation is built on the principle that children are not a burden, but the future of humanity, and every child deserves love, safety, education, health, and dignity.

(4) The Foundation operates as a Slovak-registered parent entity. Its operational activities are currently carried out through a project-based presence in the Chiang Mai Province, Thailand, as the first phase of its international programme.

§2 – Child Protection and Moral Framework

(1) Angelus – Cahaya Anak protects the child as the highest principle, without any exceptions.

(2) The child is not a property, tool, or object of any ideology, religion, or political system.

(3) The Foundation works exclusively for the child and the protection of life and dignity.

(4) Any form of abuse, humiliation, fear, manipulation, psychological pressure, or physical punishment is absolutely forbidden.

(5) All actions must always focus on the best interest of the child and the protection of the child's future.

§3 – Ethical Principles and Values

(1) The Foundation is built on transparency, strict ethics, personal accountability, and zero tolerance for corruption.

(2) The Foundation rejects any kind of misuse of donations, public funds, or influence.

(3) Any unethical behavior, deception, self-interest, manipulation, or abuse of power is incompatible with Angelus – Cahaya Anak.

(4) The Foundation operates with honesty, respect, moral discipline, humility, and human dignity.

(5) All persons connected to the Foundation must act ethically and responsibly at all times.

§4 – Responsibility, Integrity, and Compensation

(1) The Foundation is non-profit and all funds are used exclusively for the mission, children, and projects.

(2) The Founder and Director is entitled to a transparent Director's Living Allowance covering reasonable living costs, visa expenses, health insurance, and costs directly related to the performance of the role. This allowance is not profit, salary, or personal enrichment. It must be documented, approved, and reported.

(3) Any compensation to any staff must be transparent and only for real work performed.

(4) No person may use Angelus – Cahaya Anak for private gain, business, or political ambitions.

(5) The Foundation shall implement internal financial controls, dual-signature requirements where applicable, and oversight systems.

§5 – Protection of Life, Animals, and Nature

(1) The Foundation recognizes the protection of life in all forms, including animals and nature, as a moral duty.

(2) Any violence toward animals is forbidden and will result in immediate disciplinary action.

(3) Angelus – Cahaya Anak promotes ecological and sustainable projects, including farming, clean water, and environmental care.

(4) The Foundation shall educate children and communities toward respect for nature and all living beings.

§6 – Health and Medical Care

(1) Health is a fundamental right and the Foundation must ensure access to basic medical care for all children in its programmes.

(2) In the current phase of operations, the Foundation cooperates with a local medical clinic in the Chiang Mai area. The Foundation commits to covering the cost of medical interventions for children in its care where financially possible.

(3) All medical decisions must be based on professional healthcare standards and the best interest of the child.

(4) A written emergency protocol is maintained on the premises at all times, including contact information for the nearest hospital and emergency services.

§7 – Psychological and Mental Support

(1) Children must be supported psychologically with compassion, stability, and professional care.

(2) The Foundation recognizes trauma as real and must provide safe environments for healing and development.

(3) Psychological care is not optional but a core responsibility of child protection.

§8 – Rules for Visits

(1) Visits to Angelus premises must be controlled, documented, and supervised.

(2) No visitor may have unsupervised access to children under any circumstances.

(3) Photography or filming of children is strictly regulated in accordance with the Foundation's Media and Child Protection Policy.

(4) Visitors must respect the dignity, privacy, and protection rules of the Foundation at all times.

§9 – Volunteers

(1) Volunteers must be carefully selected and oriented before beginning any activity involving children.

(2) No volunteer may act independently or without direct supervision at any time.

(3) Volunteers must follow safeguarding rules, the Code of Ethics, and all internal regulations.

(4) Any violation results in immediate termination of cooperation.

§10 – Working Staff and Internal Regime

(1) Staff members are responsible for the direct care, protection, education, and development of children.

(2) Staff must be trained, ethically stable, and subject to clear supervision and accountability structures.

(3) Any staff member who violates child protection rules is removed immediately and, where applicable, reported to authorities.

(4) Staff must follow all internal orders, protocols, and ethical codes.

§11 – Educational Programme and Life Preparation

(1) Education is a central mission of Angelus – Cahaya Anak.

(2) Children must be educated for real life, including skills, discipline, responsibility, and independence.

(3) The Foundation rejects the model of survival aid only. It builds real futures.

(4) The Foundation partners with LearnFree as its official educational partner, providing access to structured learning programmes for children and adults. The Foundation ensures access to devices, internet connectivity, registration support, and dedicated staff assistance for programme participants.

§12 – Economic Self-Sufficiency and Sustainability

(1) Angelus – Cahaya Anak aims to develop self-sustaining operations through farming, agricultural production, and sustainable development activities.

(2) Donations are used to build systems that generate long-term stability, not to create dependency.

(3) The Foundation supports the empowerment of the communities it serves.

§13 – Projects and Development Strategy

(1) The Foundation develops long-term projects in care, education, agriculture, and community support.

(2) All projects must be ethically justified, transparent, and aligned with the Foundation's mission.

(3) Projects must always prioritize the protection and development of children and the communities they belong to.

§14 – Anti-Corruption and Financial Controls

(1) Corruption is treated as one of the highest threats to the mission and will be met with immediate removal and legal action.

(2) The Foundation implements strict rules for accounting, reporting, receipts, and auditing.

(3) Any misuse of funds results in immediate removal from all roles and, where applicable, criminal proceedings.

(4) Donations must always reach their real purpose: children and projects.

§15 – Transparency, Reporting, and Public Responsibility

(1) The Foundation commits to full transparency toward donors, partners, and the public.

(2) Regular reports must be created and published based on factual data and real outcomes.

(3) Manipulative marketing, deception, and false narratives are forbidden.

§16 – Media, Communication, and Image Policy

(1) All communication must protect the dignity of children and must never exploit suffering for publicity purposes.

(2) Children may never be used as marketing instruments.

(3) All communication must be truthful, respectful, and ethically responsible.

(4) Any media cooperation must follow the Foundation's safeguarding and privacy rules.

§17 – Data Protection and Confidentiality

(1) All child data, personal files, background information, and medical records are strictly confidential.

(2) Access is limited to authorized persons only.

(3) Any data breach is considered a serious violation and shall result in disciplinary and, where applicable, legal consequences.

§18 – Internal Discipline and Enforcement

(1) Internal rules must be enforced consistently and without exception.

(2) Any breach of safeguarding, ethics, or financial protocol is investigated and addressed.

(3) The Foundation operates on discipline, responsibility, and moral integrity.

§19 – Cooperation with Partners and Donors

(1) The Foundation cooperates only with partners who respect ethics, transparency, and child protection.

(2) Donors must be treated with respect, honesty, and full accountability.

(3) No donor may influence the mission in a way that harms children or violates the Foundation's ethical standards.

§20 – International Standards and Local Adaptation

(1) Angelus – Cahaya Anak follows international child protection standards and ethical frameworks.

(2) Local cultural adaptation must never reduce the level of protection provided to children.

(3) If local systems are inadequate or corrupt, the Foundation must act independently to protect children.

§21 – Relations with State Authorities and Institutions

(1) The Foundation cooperates with state authorities where beneficial, lawful, and in the best interest of children.

(2) In Thailand, the Foundation maintains active cooperation with the Local Social Welfare Office, the Immigration Bureau of Chiang Mai, and the Thai Police where necessary.

(3) Cooperation must never compromise child protection, ethics, or transparency.

(4) The Foundation reserves the right to refuse cooperation with structures that are corrupt or act against the interests of children.

§22 – Governance Structure

Angelus – Cahaya Anak operates under a three-tier governance structure designed to ensure accountability, ethical oversight, and operational effectiveness.

§22.1 – Founder and Director

(1) The Founder and Director is the executive head of the Foundation, responsible for all operational decisions, strategic direction, and implementation of the mission.

(2) The Founder and Director acts as the sole authority for Charter amendments and strategic decisions until a Board of Directors is formally established.

§22.2 – Board of Directors

(1) The Board of Directors is the governing body of the Foundation and is responsible for strategic oversight, financial approval, and accountability.

(2) The Board is established following the formal legal registration of the Foundation.

(3) Members are proposed by the Founder and confirmed by a majority vote of the existing Board.

§22.3 – Supervisory Board

(1) The Supervisory Board is an independent oversight body responsible for monitoring the ethical, financial, and operational conduct of the Foundation.

(2) Members of the Supervisory Board may not hold any direct employment or executive role within the Foundation.

(3) Preference is given to retired professionals, community experts, and persons of recognized integrity.

(4) Minimum composition: three members, proposed by the Founder and confirmed by the Board of Directors.

(5) The Supervisory Board has the authority to review finances, assess compliance with the Code of Ethics and safeguarding standards, and recommend corrective actions to the Board of Directors.

(6) Reports of the Supervisory Board are binding for the Board of Directors, which must review and respond within 30 days. If the Board fails to act, the Supervisory Board is authorized to make its findings public through the annual report or the Foundation's website.

(7) In cases of serious risk to children or financial misconduct, the Supervisory Board may contact legal authorities or the Founder directly.

(8) If neither the Board nor the Supervisory Board is able to act in an emergency, responsibility passes immediately to the Executive Director to ensure the protection of children and continuity of operations.

§23 – Legal Protection, Intellectual Property, and Ethics

(1) The Foundation protects its legal identity, documents, mission, and intellectual property.

(2) Any misuse of the Foundation's name, logo, or documentation is strictly forbidden.

(3) Legal action may be taken against abuse, defamation, or corruption involving the Foundation's identity.

§24 – Amendments and Supplements to the Charter

(1) In the current phase, this Charter may be amended only by the Founder and Director.

(2) Following the establishment of the Board of Directors, amendments require approval by the Board.

(3) Any amendment must strengthen, not weaken, child protection and the ethical standards of the Foundation.

(4) All amendments must be documented, dated, and archived.

§25 – Validity, Seat, and Language

(1) This Charter is valid as the highest internal governing document of Angelus – Cahaya Anak.

(2) The parent organization is registered in the Slovak Republic. The operational presence in Chiang Mai Province, Thailand functions as a project-based field operation under the parent entity.

(3) The English version of this Charter is authoritative for all international cooperation, documentation, and legal purposes.

§26 – Final Provisions

(1) This Charter enters into force on the date of adoption by the Founder and Director.

(2) All persons connected to Angelus – Cahaya Anak are bound by this Charter from the moment of their association with the Foundation.

(3) This Charter shall be published on the organization's website as a declaration of transparency, ethical identity, and commitment to the children it serves.

Angelus – Cahaya Anak is built on the belief that safety and freedom can exist together. Every child deserves love, protection, education, and dignity — regardless of where they were born, who their parents are, or what circumstances brought them to our door. This Charter is our promise.
